Escondido police are investigating a fatal accident Wednesday, December 23, 2009 in Escondido. Arthur Tingleaf, 74, of Escondido, was crossing Begonia Street near his home when he was struck by an out-of-control Honda Accord. The crash occurred shortly after 2 p.m. on Wednesday afternoon. Tingleaf was taken via ambulance to Palomar Hospital where he died a short time after arrival.

Please keep the family of Arthur Tingleaf in your prayers, as the sudden and unexpected loss of a loved one is surely devastating. Our sympathy goes out to everyone who knew and loved this man. According to reports of the accident in the San Diego Union Tribune, authorities interviewed the driver of the Honda Accord that struck Tingleaf, but did not make an arrest. Police do not believe alcohol was a factor in the fatal pedestrian accident, however the incident is still under investigation.

Based on the news reports of this accident, it is not clear why the driver of the vehicle lost control of his car, or if he was speeding or driving recklessly. It is a possibility that something distracted the driver, or even that something malfunctioned mechanically on the Honda Accord. Even if the driver is not held responsible criminally for the accident, he may be held liable in a civil claim for wrongful death. The family of Arthur Tingleaf would be well advised to consider consulting with a San Diego wrongful death attorney to discuss their legal rights and options. An attorney will review the facts of the accident and make sure the legal rights of the family are protected.
